Terms of Service
These terms govern the 3D scanning and related services Sydney Scan Co provides. They set out what we deliver, what each side is responsible for, who owns what, and the limits of our responsibility. We have written them in plain language.
01These terms
These terms apply to every quote, booking and project unless we agree otherwise in writing. By engaging us, you accept them.
02What we do
We provide 3D reality capture, hosted digital twins and virtual tours, photorealistic renders, measured as-built drawings, and scan-to-CAD and scan-to-BIM modelling. We capture building geometry and conditions. We do not provide cadastral, boundary or legal land-survey services, which are a separate, regulated service.
03Quotes, prices and GST
Prices shown on our website are indicative starting points. We give a fixed price for your specific project once we understand it. Prices are quoted exclusive of GST unless stated otherwise. A quote is valid for 30 days unless we say otherwise.
04Booking, access and your responsibilities
You are responsible for arranging safe and timely access to the site, and for telling us about hazards, restricted areas and anything else we need to know to scan safely. If access is delayed or refused on the day, we may charge for the wasted visit.
05Deliverables and timeframes
We deliver the files set out in your quote. We aim to return data within the timeframe we give you, typically within five business days of capture for standard scopes, but timeframes depend on scope, site conditions and access. We will tell you if anything will affect them.
06Accuracy
We capture with the Matterport Pro 3, which records to about plus or minus 20mm at 10 metres. That figure is the manufacturer's instrument specification under nominal conditions, not a guaranteed delivered result. Achieved accuracy varies with range, surface, incidence angle and registration, so we state a project-specific tolerance in every scope of work. We do not provide survey-grade, structural-setout or boundary accuracy, and you should not rely on our deliverables for those purposes.
07Who owns what
- You own the final paid deliverables we produce for you, such as the as-built drawings and the measured CAD or BIM model, once you have paid for them in full.
- We retain ownership of the raw point cloud, the registration and processing data, and our methods, tools and know-how. We grant you a licence to use the raw point cloud for the purposes of your project.
- Nothing in these terms transfers ownership of our pre-existing materials or our methods.
08Hosted digital twins
Where your engagement includes a hosted 3D twin, it is hosted on a third-party platform and provided on a subscription basis. The twin stays live while the subscription is current. If the subscription lapses or the engagement ends, hosting may stop and the twin may become unavailable. Tell us before then if you need an export or an archive copy, and we will help where the platform allows.
09Confidentiality
We treat your building data and project information as confidential. We will not disclose, reuse or publish it, including as a case study, portfolio piece or marketing example, without your written consent. We ask for the same care from you in respect of our methods and pricing.
10Payment
We invoice as set out in your quote. Payment is due within the terms shown on the invoice. We may withhold deliverables until payment is received in full.
11Cancellation and rescheduling
Tell us as soon as you can if you need to move or cancel a booking. A cancellation or reschedule at short notice may incur a fee to cover the reserved time.
12Our responsibility to you
We provide our services with due care and skill. To the maximum extent permitted by law, our total liability arising out of or in connection with our services is limited, at our option, to re-supplying the services or paying the cost of having them re-supplied. We are not liable for indirect or consequential loss.
13Your rights under the Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where the law allows us to limit our liability for failing to meet a consumer guarantee, that liability is limited to re-supplying the services or paying the cost of re-supply.
14Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state.
15Changes to these terms
We may update these terms from time to time. The version that applies to your project is the one in effect when we agree to do the work.
